Regarding the situation generated within the framework of the publication of results of the Higher Education Access Test (PAES), we state the following:

  1. The Undersecretariat has the obligation to comply with current regulations, which provide that access processes and instruments must comply with the provisions of Law No. 19.628, on the Protection of Private Life, which is endorsed in the regulations of the System. of Access. The main purpose and reason of this regulation is to protect the rights of students, especially their constitutionally enshrined right to respect for private life and protection of their personal data. In response to this, the Undersecretariat must strictly comply with the specific authorization that each student makes at the time of registering for the PAES, which enables the processing and use of their data only for the management of the admission and enrollment processes, a safeguard that is must be adopted in the databases -nominated with RUT- used by educational institutions.
  2. The regulation of the Access System has been the result of the agreements of the Technical Committee for Access to the University Subsystem, which is chaired by the Undersecretariat and made up of seven rectors representing the entire system. In this sense, safeguarding compliance with regulations is also safeguarding the system's own agreements.
  3. As Undersecretary, we deeply value research and analysis, as they allow us to advance in the continuous improvement of the system based on evidence. Precisely for this reason, the information from the previous processes is available for download on the “Open Data” portal of the MINEDUC (http://datosabiertos.mineduc.cl). Following the regular procedure, which has been adopted every year, the PAES 2024 data will be uploaded in the month of April, once the admission process has concluded and the data is duly anonymized. The purpose of this procedure is to make academic interest and public opinion compatible, with the due protection of personal information and the rights of students.
  4. Without prejudice to the above, as Undersecretary we will propose to the Technical Access Committee, at its regular meeting on January 11 of this year, to begin the work of updating the data use policy at the State level for admission processes. whose design must be led by this Committee. Thus, the articulation of citizens' right to information, the need for academic research on admission processes based on anonymized data, and the proper use of tests and instruments will be strengthened.
  5. We are convinced that updating the data policy for admission processes will be one more step in the consolidation of the PAES, a public policy that has been implemented during three different governments, and that has awakened a transversal consensus. We will continue working together with the Technical Access Committee and all the institutions of the system towards a more equitable and fair Access System, which puts the applicants at the center, and which leads the country towards greater equality and inclusion in access. to higher education.
